Why Not People? Membership Terms and Conditions
We are Why Not People Limited, a private limited company incorporated in England and Wales with registered company number 08669848 (WNP, we, us). We operate through the website www.whynotpeople.com.
You agree to be bound by these Terms while you are a member. However, nothing in these Terms shall affect your statutory rights.
WNP is a new community, and we are developing a range of benefits for people living with a disability. Membership entitles you to the following:
• A welcome pack which includes your personal membership ID tag. Please keep your tag safely, as you will need it to get into events. If you lose your tag we will replace it for which there will be a small administration charge of £5.
• The right to apply to buy tickets to our exclusive music events.
• Access to the password-protected sections of our website which contain a number of offerings for members.
• A monthly newsletter with the latest news and updates on everything you should know that is happening around you, and competitions to enter.
As WNP is an evolving project, we may add to and improve membership rights at any time. We may also remove any services which are not popular with our members.
Membership Application Process
As WNP is a club aimed at people with a disability, only those living with a disability are allowed to join as members. In order to become a member, we will need to confirm that you qualify as disabled under UK law.
• You are automatically considered to be disabled under UK law if you have cancer, HIV, multiple sclerosis, a severe disfigurement, or you are blind/partially sighted.
• You are also considered to be disabled under UK law if you have a physical or mental condition which has a long term and substantial effect on your day to day life.
When you apply for membership please supply us with basic information about your disability. If you have any documents that demonstrate your disability, such as a form showing that you receive disability allowance, or a disabled person's railcard, you may be asked to upload copies after you have submitted your application. All the information and evidence you provide will be reviewed by our Chief Medical Officer, Professor Nick Webborn, who will check that your condition fits the legal definition set out above.
We will get in touch via email to confirm that we either accept or reject your application, or to ask you to provide further details about or evidence of your disability. Either way we will try to get back to you within a month.
If we reject your application it will be because we do not believe your condition falls within the legal definition of disability, or because we believe your application is dishonest or inappropriate. Our decision as to your eligibility for membership of WNP will be final.
Our membership is free.
When we confirm your membership, you will receive a username and password (which you may change) to access the member's section of the website and your online account. Please treat these access details as confidential and do not disclose them to any other person. If you change your mind, you can request us to terminate your membership within 14 days of your receipt of confirmation of your membership.
If any of the information you've provided for the purposes of demonstrating your disability is subsequently found to be false or misleading, we have the right to revoke your membership immediately.
We will not automatically renew your membership each year. Instead, we will notify you one month before your membership is due to expire, and you will be asked whether you wish to renew. If you do wish to renew, you will be asked to confirm whether your disability has altered in any way in the previous year. If it has, you will be required to re-apply for membership using the application process described above.
You must be 13 or over to be a member of WNP. If you are under 16 please obtain the consent of your parent or guardian before applying to join.
Membership is non-transferable.
Event Ticket Sales
Subject to any advertised restrictions for any particular event, each member is entitled to apply for one ticket for themselves and up to three tickets for family and friends for each event, and those family and friends may be either disabled or able-bodied. If you are under 16, you must obtain the consent of a parent or guardian to buy tickets, and you must be accompanied by at least one adult at the event. Please note that tickets are subject to availability, so first come first served is the rule!
Please note that membership does not give you the right to apply for tickets to all events, because each event will have its own separate ticketing policy, and some events will be reserved for members with certain disabilities, and some events may have age restrictions.
In order to apply to buy tickets for an event please complete and submit the form on our website which you can find at: http://whynotpeople.com/membership/become-a-member. We will check availability (and if applicable, your eligibility) on receipt of your application, and provided relevant seats/space is available and you are eligible we will send you a ticket code, and send you a link to our ticket agent, which is currently Ticket Agent. You will need to complete the buying process with Ticket Agent, and you will need to apply the code we give you during that process.
For each event the ticket supplier's terms and conditions apply to all ticket sales, and to any refunds and exchanges (where applicable). We cannot be liable for any errors in the issue or the non-issue of tickets by the ticket supplier, and you are advised to check your tickets to ensure they are correct.
We hope and expect that ticket buyers will honour the aims of WNP to provide access to events for disabled people who may not otherwise be able to attend such events. So please do not re-sell your own ticket to any gig you have bought. To preserve the reputation of WNP we reserve the right to refuse to issue ticket codes to any member found to be repeatedly re-selling tickets they have bought to our events.
We reserve the right to make alterations to the advertised line-up or content of any event if necessary due to events beyond our control.
Event Safety and Enjoyment
We do all we can to make appropriate arrangements for all disabilities of which you have made us aware at our WNP-branded events, and we use all reasonable endeavours to ensure that the venues are able to accommodate all such disabilities. However, we do not inform any venue in advance of the specific disabilities of each member who is attending any particular event (nor would you want us to do so), and so if you are prevented from entering a venue for any reason, or if, having entered the venue, you find that the special facilities you need are not available at the venue, our representative at the venue will use reasonable endeavours to resolve the issue, but we cannot be liable (except in the case of our negligence) for any refusal of admission or inappropriate seating or positioning.
Please note that any venue is likely to have the right under its own entry policies to refuse entry to any person if it considers it necessary or advisable to do so, whether for safety reasons or otherwise. All venues also have house rules as regards latecomers, use of mobile phones, use of glasses and food and drink, and other such matters. You are asked to comply with all such rules.
Please note that strobe lighting, smoke effects and loud sudden noises may sometimes be used at events. There may not be any visual or audible warnings beforehand.
Important: If you believe any venue access, facilities, rules, or any event content may cause you difficulties it is your responsibility to contact us before you book any event tickets with your concerns. We will try our best to accommodate your requirements but we are to a large extent at the mercy of the venue owners, and if we are unable to accommodate your requirements at a particular venue for any reason we have the right to refuse you access to the venue if we feel it is advisable in the interests of safety or otherwise. Please respect our decision, which we will make in good faith.
Please note that we also from time to time will offer tickets for sale in WNP-reserved areas at events which are not WNP-branded gigs. We are not able to make any special arrangements in respect of these events, so please do not book tickets for these events if you believe that access, seating or other house rules may be a problem for you.
WNP Website Use
We may refuse to post and we have the right to remove anything from the website which, in our opinion, is illegal or objectionable or does not comply with these Terms.
Your personal profile page on the website is viewable only by means of access through your own username and password. No other users will see your profile page. You are free to contribute to chat rooms, comment on blogs and post items when invited to do so on certain sections of the website, but please bear in mind that all such items, and with them any username and photo you upload to your profile page, will be available for all WNP members to see.
We may record, preserve, trace and disclose anything which has been transmitted to, from or via our website where required to do so by law.
The website and its content is protected by intellectual property rights. You may not modify, copy, transmit or distribute the website or any content on the website (including the WNP name and logo) except as may be expressly permitted on the website.
We cannot guarantee that all parts of the website will always be functional. We urge you to notify us of any functionality issues by emailing us at the address set out below. We will not be liable for any losses incurred by you as a result of any delay or inability to use the website.
Our website may contain links to websites operated by third parties. We have no control over these websites, so we do not endorse the content of any linked websites. By clicking on links, you proceed at your own risk.
We cannot be liable for everything that could happen to you during your membership. Except in the case of our own negligence, we cannot be liable for any injury, loss or damage that you may suffer at any event, or in transit to or from such events.
We try to monitor all postings to our website, but we are a small team and we may on occasion miss items posted by third parties that are objectionable, defamatory, abusive or simply incorrect. We are not liable for any reliance on any such items, or for any offence or injury taken.
Nothing in these Terms excludes or limits:
• Our liability for death or personal injury caused by our negligence; or
• Any other liability which may not be excluded or restricted by law.
We reserve the right to terminate your membership on notice to you if we believe that you are in breach of these Terms. We have no obligation to refund any membership fees paid in such event.
These Terms, together with the documents incorporated by reference, form the entire terms and conditions of your membership.
If any part of these Terms is held to be unenforceable this will not affect the enforceability of the remaining provisions.
We may occasionally update these Terms. When we do, we will revise the "last updated" date at the bottom of the Terms. Please ensure that you check these Terms frequently for any updates.
Governing Law and Jurisdiction
These Terms, together with the documents incorporated by reference, are governed by English law and all disputes shall be submitted to the exclusive jurisdiction of the English courts.
